Terms and Conditions

§ 1 Validity, definitions

  1. NordvindCamper GbR, Frohmestraße 59, 22459 Hamburg, Germany (hereinafter: "we" or "Nordvind") operates an online shop for goods at the website https://nordvind.shop. The following general terms and conditions apply to all services between us and our customers (hereinafter: "customer" or "you") in the version valid at the time of the order, unless otherwise agreed in writing.

  2. "Consumer" within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. "Entrepreneur" is a natural or legal person or a partnership with legal capacity which, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity, whereby a partnership with legal capacity is a partnership that is endowed with the capacity to acquire rights and incur liabilities.

§ 2 Conclusion of contracts, storage of the contract text

  1. The following regulations on the conclusion of contracts apply to orders via our online shop at https://nordvind.shop

  2. The presentation of goods in our online shop does not constitute a legally binding contract offer on our part, but is merely a non-binding invitation to the customer to order goods. By ordering the desired goods, the customer makes a binding offer to conclude a purchase contract.

  3. When an order is received in our online shop, the following regulations apply: The customer submits a binding contract offer by successfully completing the ordering procedure provided in our online shop. The order is placed in the following steps:

    1. Selection of the desired goods,
    2. Adding the products by clicking on the corresponding button (e.g., "Add to cart", "Add to shopping bag" or similar),
    3. Checking the information in the shopping cart,
    4. Accessing the order overview by clicking on the corresponding button (e.g., "Proceed to checkout", "Proceed to payment", "To order overview" or similar),
    5. Entering/checking address and contact details, selection of payment method, confirmation of the T&Cs and cancellation policy,
    6. Provided that the agreed quality of the goods deviates from their usual quality and requirements for use, confirmation of a negative quality agreement,
    7. Finalization of the order by pressing the button "Buy now". This constitutes your binding order.

  4. We can accept the customer's offer within one week,
by sending the customer a written order confirmation or an order confirmation in text form (fax or e-mail), whereby the receipt of the order confirmation by the customer is decisive in this respect,
by delivering the ordered goods to the customer, whereby the receipt of the goods by the customer is decisive in this respect,
by requesting the customer to pay after submitting their order.
If several of the aforementioned alternatives exist, the contract is concluded at the time when one of the aforementioned alternatives occurs first. The period for accepting the offer begins on the day after the offer is sent by the customer and ends with the expiry of the fifth day following the sending of the offer. If we do not accept the customer's offer within the aforementioned period, this is deemed to be a rejection of the offer with the consequence that the customer is no longer bound by their declaration of intent. In the event of a contract conclusion, the contract is concluded with NordvindCamper GbR, Frohmestraße 59, 22459 Hamburg, Germany.

  5. In the case of payment by advance payment or Sofortüberweisung, the order confirmation follows immediately after the order confirmation, which thus represents a binding contract conclusion.

  6. Before ordering, the contract data can be printed out or electronically saved using the browser's print function. The processing of the order and transmission of all information required in connection with the conclusion of the contract, in particular the order data, the T&Cs and the cancellation policy, takes place via e-mail after you have placed the order, partly automatically. The contract text is stored by us after the contract is concluded and transmitted to you in text form (e.g., e-mail). You can retrieve the order data via your password-protected user account on our website, provided you have created a user account before sending your order.

  7. Input errors can be corrected using the usual keyboard, mouse and browser functions (e.g., browser "back" button). They can also be corrected by cancelling the ordering process prematurely, closing the browser window and repeating the process.

  8. The processing of the order and transmission of all information required in connection with the conclusion of the contract takes place via e-mail, partly automatically. You must therefore ensure that the e-mail address you have deposited with us is correct, that the receipt of e-mails is technically ensured and, in particular, not prevented by SPAM filters.

§ 3 Subject matter of the contract and essential features of the products

  1. The subject matter of the contract in our online shop is:

    1. The sale of goods. You can find the specific goods offered on our product pages.

  2. The essential features of the goods can be found in the product description. If the agreed quality of the goods deviates from their usual quality and requirements for use, this will be expressly pointed out in the product description (negative quality agreement). Insofar as the customer has given their express consent to the negative quality deviation, this defines the subject matter of the contract.

§ 4 Prices, shipping costs and delivery

  1. The prices stated in the respective offers as well as the shipping costs are total prices and include all price components including all applicable taxes.

  2. The respective purchase price must be paid before the delivery of the product (advance payment), unless we expressly offer purchase on account. The payment methods available to you are shown under a correspondingly designated button in the online shop or in the respective offer. Unless otherwise stated for the individual payment methods, the payment claims are due for payment immediately.

  3. In addition to the prices stated, shipping costs may be incurred for the delivery of products, unless the respective item is shown as free of shipping costs. The shipping costs will be clearly communicated to you again on the offers, if applicable in the shopping cart system and in the order overview.

  4. Unless we have clearly stated otherwise in the product description, all items offered by us are ready for dispatch within 3-5 working days. Delivery will take place no later than within 14 working days. In the case of payment in advance, the delivery period begins on the day after the payment order is issued to the bank commissioned with the transfer, and for all other payment methods on the day after the contract is concluded. If the last day of the period falls on a Saturday, Sunday or a public holiday at the place of delivery, the period ends on the next working day.

  5. There are the following delivery area restrictions: Delivery is made to the following countries: Germany.

  6. The risk of accidental loss and accidental deterioration of the sold item passes to the buyer or a person authorized to receive it only upon delivery of the item, even in the case of mail-order purchase.

§ 5 Right of retention, retention of title

  1. You can only exercise a right of retention insofar as it concerns claims from the same contractual relationship.

  2. The goods remain our property until the purchase price has been paid in full.

§ 6 Right of withdrawal

As a consumer, you have a right of withdrawal. This is governed by our cancellation policy.

§ 7 Limitation of liability

Our liability is limited to intent and gross negligence, as far as legally permissible. We are not liable for slightly negligent breaches of non-essential contractual obligations. Liability under the Product Liability Act remains unaffected.

§ 8 Contract language

The contract language is exclusively German.

§ 9 Warranty

  1. The statutory warranty provisions apply to consumers. If the delivered goods are defective, you have the right to subsequent performance, reduction of the purchase price or withdrawal from the contract, as provided by law.

  2. As a consumer, you are requested to check the item/digital goods or the service provided immediately upon fulfillment of the contract for completeness, obvious defects and transport damage and to notify us and the carrier of any complaints as soon as possible. If you fail to do so, this will of course have no effect on your statutory warranty claims.

  3. For entrepreneurs, the warranty period for delivered goods is 12 months.

§ 10 Final provisions/dispute resolution

  1. German law applies. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn (favorable principle).

  2. The provisions of the UN Convention on Contracts for the International Sale of Goods are expressly excluded.

  3. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the provider's registered office.

  4. We reserve the right to change these T&Cs at any time with effect for the future. Changes will be published on our website and are effective from the time of publication.

  5. Should individual provisions of these T&Cs be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, a provision shall be adopted that comes closest to the economic purpose of the invalid or unenforceable provision.
